Terms & Conditions
PREAMBLE
These conditions are agreed between the brand BBme by Joana Teles, based at Rua Sara Afonso, 55 – 2785-540 São Domingos de Rana, Cascais, henceforth referred to as BBme by Joana Teles and between any person wishing to make a purchase through the BBme by Joana Teles www.bbme.pt, hereinafter referred to as “User”.
Orders will be dispatched worldwide.
These conditions apply only to singular persons who are not traders.
Both parties agree that their relationship will be governed exclusively by the general conditions described in this text.
ARTICLE 1 – OBJECT
The purpose of these conditions is to define the general terms of sale established between BBme by Joana Teles and the User from the time of order to the various services provided by BBme by Joana Teles, such as payment methods and delivery terms the order.
These conditions regulate all the steps necessary to carry out the order and guarantee the follow-up of this transaction between the contracting parties.
ARTICLE 2 – ORDER
The User will be able to place his order online, on the site www.bbme.pt.
To finalise your order, the User must provide the personal data. For this, the user must fill in all the required fields of the order form for this purpose. By placing your order, the user expresses his complete acceptance of the general conditions of sale, prices and description of the products contemplated in this transaction. These general conditions of sale shall be the only applicable to both parties.
Any dispute over this last point will be resolved through an exchange of information and with the guarantees mentioned below.
In the absence of availability of the product, BBme by Joana Teles undertakes to inform the User and to reimburse the User for any amounts that may have been paid within a maximum period of thirty (30) days from the date of knowledge of such unavailability.
BBme by Joana Teles reserves the right to send the order after good collection thereof.
ARTICLE 3 – DELIVERY
The shipping cost is € 3.50 to addresses in Portugal and € 7.50 to rest of the World. The orders can be delivered:
– At your home – to the address that appears in our database. The order will be delivered to your home, via CTT. If you are not at the indicated address, a CTT postal card will be left, and you ‘ll have to collect your order at the respective post office.
– In another address:
BBme by Joana Teles will deliver your order wherever you wish. You need to specify a new address when completing the order form, in the field “delivery address”. This service has no extra costs.
To track the status of the order, you can do it online at “Follow order” at www.bbme.pt.
If all the items in your order are readily available, the delivery time is, on average, from 24h to 48h on business days, for orders paid via PayPal, credit card or whose proof of payment is sent to geral@bbme.pt. Sold out items will not be shipped.
ARTICLE 4 – PAYMENT
BBme by Joana Teles proposes to the client several payment methods:
– By credit card (Visa and Mastercard): the order and card data will be sent, duly encrypted, to the bank on the date of your order. After validation and communication from your bank, the order will be processed. In case of refusal, your order will be cancelled.
For refund situations:
– Items not picked up or returned – refund will be made to the credit card.
– Items sold out or cancelled – no debit is made on the credit card.
– Order cancelled – no debit is made on the credit card.
– With ATM: by choosing this mode of payment, you will receive an email with the data to make the payment in an ATM or Homebanking service on the Internet.
– With PayPal: ff you choose this method of payment, the value of the order will be charged at the end of the order.
For refund situations:
– Items not picked up or returned – refund will be made through your PayPal account.
– Items sold out or canceled – refund will be made through your PayPal account.
– Order canceled on the same day – refund will be made through your PayPal account.
ARTICLE 5 – PRICES
The prices must be understood in euros, with taxes and shipping costs to Portugal, included. The prices shown are based on the VAT applicable at the time of invoice. Any modification of the applicable VAT rate will be reflected in the prices of the products. After this date prices may be modified at any time.
Prices and specifications are subject to change without notice. BBme by Joana Teles declines any responsibility for any errors published on the site www.bbme.pt. In the treatment of your order, any price error that may be appearing on the site due to technical anomalies will be detected. In this situation, the customer is contacted. If the price of the product presented on the site is, in reality, lower, the difference is returned. If the price is higher, the customer will be contacted and can accept or cancel the order.
ARTICLE 6 – GUARANTEES & FREE RESOLUTION
You may return/terminate the contract in the following situations:
– The customer has the right to return the purchase within a maximum period of 14 days from the delivery date of the article.
– If you wish to make a return, you must first contact us by e-mail geral@bbme.pt, stating the intention to return.
– The returned items must be in perfect condition, complete and properly packed in the original packaging and without any signs of effective use.
– BBme by Joana Teles will only be responsible for the costs of return and resend if there is an internal error and if the product sent does not correspond to the request, if the product is defective in origin and if it has been damaged during the transport. In case of withdrawal or error of the customer, the return costs will be entirely the responsibility of the customer.
– The customer will be refunded, of the amount paid for the articles, to his IBAN. In case you have paid with VISA / Mastercard or PayPal, the refund will be made directly on the card.
ARTICLE 7 – RESPONSIBILITY
For all stages of access to the site, from the order process to delivery or subsequent services, BBme by Joana Teles only has a media obligation. BBme by Joana Teles excludes all guarantee and any liability for the inconveniences or damages inherent to the use of the Internet network, in particular, a service interruption, an external intrusion or the presence of computer viruses, or any case of force majeure classified by the jurisprudence of the courts, to the extent permitted by applicable law.
Items sold are described and displayed on the site as accurately as possible. If despite all our precautions, errors occur on the site, BBme by Joana Teles will not be held responsible for this fact. Except in case of guarantee, any operation between BBme by Joana Teles and its Users, not disputed within six months, cannot give rise to any claim.
ARTICLE 8 – TREATMENT OF PERSONAL DATA
In compliance with Law no. 67/98 of 26 October, on the Protection of Personal Data, we inform you that the treatment of the personal data collected on the site www.bbme.pt is the responsibility of BBme by Joana Teles, headquartered at Rua Sara Afonso, 55 – 2785-540 São Domingos de Rana Cascais. The personal data are handled in an automated way, for the correspondence corresponding to their orders, their administrative support and statistical purposes. The personal data collected may be communicated to third parties of recognised suitability for direct marketing purposes.
The owner is guaranteed the right to access, rectify, modify or delete his / her data, to do so directly contact us with your name, surname, address and the client:

The User authorises BBme by Joana Teles to treat in an automated manner the personal data provided, in particular by the use of cookies.
You can access and modify your data at any time in “My account”, on the BBme by Joana Teles website.
ARTICLE 9 – INTELLECTUAL PROPERTY
All elements of the BBme by Joana Teles website, whether visual or sound, including the underlying technology, are protected by copyright, trademark or patent. They are the exclusive property of BBme by Joana Teles.
The User who has a personal Internet site and wishes to place, for personal use, on his website a simple, direct link to the homepage of the BBme site by Joana Teles, must request authorisation from BBme by Joana Teles. In this case, it will not be an implicit agreement of affiliation or partnership.
On the other hand, any hypertext link directed to the BBme by Joana Teles website and using the framing technique or in-line linking is formally prohibited.
In all cases, any link, even tacitly authorised, should be withdrawn with a simple request from BBme by Joana Teles.
ARTICLE 10 – TOTAL AGREEMENT
The present general conditions of sale constitute the total agreement between the parties in reference.
If one of the clauses of these conditions becomes null and void, by a legislative, normative or sentence change, this should in no way affect their validity and respect.
ARTICLE 11 – DURATION
These conditions apply throughout the services offered by BBme by Joana Teles.
All articles unique to the site are valid up to the limit of available stocks.
ARTICLE 12 – PROOF
The computerised records kept in the security systems of BBme by Joana Teles are considered as proof of communications, orders and payments produced by both parties.
ARTICLE 13 – CONSERVATION AND ARCHIVE OF TRANSACTIONS
Orders and invoices will be archived on a reliable and durable medium to correspond to a faithful and lasting copy.
ARTICLE 14 – APPLICABLE LAW AND COMPETENCE
The terms of the sale presented apply to the Portuguese law.
To resolve any dispute, there is always the possibility to resort to an arbitration body.
The European Union has set up a website to support consumers to submit their complaints on any litigation in which they are involved. In this context, BBme by Joana Teles provides all the information so that you can exercise your right to complain to an official and impartial third-party that will help you resolve the dispute in question. In the absence of resolution by agreement of the parties, any litigation arising from these General Conditions of Sale will be submitted to the competent Portuguese court.
